2HOURS S.r.l. (hereinafter, “Controller” or “2HOURS “), as the data controller, informs you, pursuant to art.13 of EU Regulation no. 2016/679 (hereinafter, “GDPR”), that your data will be processed in the following manner and for the following purposes:

1.Purpose of Processing
The Controller processes the user’s identification and usage data generated during interaction with the Controller’s website (the “Site”), accessible at the following address https://2hours.it/ – hereinafter, “personal data” or “Data.”
The Site is also capable of tracking some information about the network used by the User (e.g., IP address).

2.Purpose and Legal Basis of Processing
Your personal data is processed for the following purposes:

  1. Allow the user to navigate the Site;
  2. Enable the user to send messages to the Controller through a specific contact form on the Site or by sending an email (Data will not be processed directly through interaction with the website);
  3. Collect statistics and metrics to ensure the proper functioning of the Site;
  4. Exercise the rights of the Controller (e.g., the right to defend in court).

The legal bases for the aforementioned processing are as follows:

  • Regarding purposes a) and b), processing is necessary for the performance of a contract to which the data subject is a party or for the performance of pre-contractual measures taken at the data subject’s request;
  • Regarding purposes c) and d), the legal basis is the Controller’s legitimate interest, i.e., monitoring the proper functioning of the Site and exercising the Controller’s rights such as defence in court.

The provision of data for the above purposes is optional. Failure to provide the Data will prevent you from interacting correctly with the Site.

Additionally, your Data may be processed only with your specific and separate consent (art. 7 GDPR) for the following marketing purposes:

  1. Sending promotional communications and informative material via email. Providing data for Marketing Purposes is optional and free. You may decide not to provide any data or later deny the possibility of processing already provided Data. You can revoke consent to data processing at any time without affecting the lawfulness of processing based on consent before revocation by following the instructions available at the bottom of each newsletter and commercial communication or by sending a communication to the email address 2hours@2hours.it. 3.Duration of Processing
Personal data will be kept for the time necessary to fulfil the purposes stated in this information. The Controller will keep, for ten years, as required by the Civil Code, a copy of correspondence of legal and commercial relevance. The user’s personal data may also be kept for the time necessary to ensure defence in court or to pursue any abuses in the use of this Site.
Data collected for marketing purposes will be kept until the user revokes consent, and in any case, for a period not exceeding 36 months if the User does not interact with the newsletters sent by 2HOURS. After the indicated retention period, personal data will be deleted or pseudonymized unless it is exceptionally necessary to retain data to defend the rights of 2HOURS S.r.l. in ongoing disputes.

4.Data Communication
The user’s data will not be disclosed but may be made accessible, where necessary for service delivery or by law:

  • to employees and collaborators of the Controller in Italy and abroad, as authorized subjects for the processing of personal data and/or system administrators;
  • to third-party companies or other subjects (such as, for example, credit institutions, professional firms, IT consultants, etc.) that perform outsourcing activities on behalf of the Controller, as external data processors.

The Controller may communicate your Data for the purposes mentioned in art. 2 to supervisory bodies, judicial authorities, and public entities to which the communication of Data is mandatory, as well as to those subjects to whom communication is mandatory by law for the fulfilment of said purposes.

5.Data Transfer
Personal data is stored on servers located within the European Union, managed by third-party companies appointed and duly designated as data processors.
The Controller may transfer certain categories of User Data to countries outside the European Union. Data will be transferred exclusively to countries considered adequate by the European Commission or to companies that meet the guarantees provided by Articles 44-50 of the GDPR.

6.Data Subject Rights
In relation to the data processing described herein, you may exercise the rights provided by the GDPR (Articles 15-22), including:

  1. receive confirmation of the existence of Data and access their content (right of access);
  2. update, modify, and/or correct Data (right to rectification);
  3. request the deletion or limitation of Data processed in violation of the law, including those for which retention is not necessary for the purposes for which the Data was collected or otherwise processed (right to be forgotten and right to limitation);
  4. object to the processing (right of objection);
  5. lodge a complaint with the supervisory authority (Italian Data Protection Authority www.garanteprivacy.it) in the event of a violation of the rules on the protection of personal data;
  6. receive a copy in electronic format of the Data concerning you as the Data Subject when such Data has been provided in the context of a contract and request that such Data be transmitted to another data controller (right to data portability).
